The rules that govern use of the CurNext marketing website, commercial engagement with CurNext, and general access to CurNext products and materials published on curnext.app.

These Terms & Conditions are a public summary of CurNext's standard website and commercial engagement terms. They are not legal advice. Where these Terms conflict with a signed order form, master services agreement, Data Processing Agreement, or other executed contract, the signed contract controls for that relationship. Product-specific Terms of Service may apply when published or attached to an order.

Purpose of these Terms

CurNext publishes a marketing website, product documentation, quote tools, and related surfaces so construction and facilities teams can evaluate and buy construction site intelligence. These Terms set expectations for visitors, leads, customers, and collaborators.

Agreement and acceptance

By accessing or using the CurNext website, submitting a contact or quote form, creating or accepting an account invitation, or otherwise engaging CurNext commercially through these surfaces, you agree to these Terms.

  • - If you use CurNext on behalf of a company, you confirm you have authority to bind that company.
  • - If you do not agree, do not use the website or submit commercial requests through it.
  • - Continued use after an update posted with a new "Last updated" date constitutes acceptance of the revised Terms, except where a signed contract requires a different change process.

What these Terms cover

These Terms apply to public and authenticated CurNext marketing and engagement surfaces unless a more specific executed contract says otherwise.

Marketing website and content

Browsing curnext.app, Docs, Knowledge Base, Resources, Careers, Events, and similar public pages; downloading publicly offered materials; and viewing product descriptions, pricing estimators, and case-study patterns.

Commercial engagement

Contact forms, quote requests, demos, partnership inquiries, and pre-contract discussions initiated through CurNext channels.

Accounts and product access (general)

Invite-only dashboard access, API keys, SDKs, and related product surfaces when used under CurNext's standard engagement model. Detailed SaaS, SLA, or support commitments may appear in an order form, Terms of Service, or support policy when executed or published.

Not a substitute for signed deals

Enterprise schedules, custom liability caps, special warranties, and data-processing instructions are set in signed documents. The Data Processing Agreement governs processor terms for Client Data.

Eligibility and age

CurNext is a B2B offering for organisations and authorised professionals.

  • - You must be able to form a binding contract under applicable law.
  • - Under CurNext internal policies, product users under 18 are not onboarded, invited, or registered to the CurNext dashboard or related product accounts.
  • - Website browsing that does not create an account may still be available subject to these Terms and our Cookie and Privacy policies.
  • - CurNext may refuse service where use would violate law, sanctions, export controls, or these Terms.

Accounts, invitations, and security

Where CurNext provides credentials, invitations, or API access, you are responsible for safeguarding them.

  • - Keep passwords, API keys, and invite links confidential and use strong authentication where offered.
  • - Tell CurNext promptly at [email protected] if you suspect unauthorised access.
  • - You are responsible for activity under your organisation's accounts and keys, except to the extent caused by CurNext's failure to apply reasonable security controls.
  • - CurNext may suspend credentials that appear compromised, abusive, or used outside authorised scope.

Acceptable use

Use CurNext surfaces only for lawful business purposes consistent with construction and facilities monitoring workflows.

  • - Do not probe, scan, or attack CurNext systems except through coordinated vulnerability disclosure to [email protected].
  • - Do not reverse engineer products except where mandatory law allows and after written notice where required.
  • - Do not upload unlawful, infringing, or harmful content; do not use the Services to harm people, property, or critical infrastructure outside their intended monitoring purpose.
  • - Do not resell, sublicense, or misrepresent CurNext materials as your own product without written permission.
  • - Do not circumvent rate limits, access controls, billing, or geographic/residency restrictions.
  • - Do not use automated scraping that degrades service or copies substantial non-public content without CurNext's written consent.

Quotes, orders, fees, and delivery

Marketing pricing and estimators are informational. Binding commercial terms are confirmed in quotes, order forms, or invoices issued by CurNext.

Quotes and estimators

Website pricing estimators and published list themes help scope a conversation. They are not a binding offer unless CurNext confirms pricing in writing.

Orders and changes

An order becomes binding when CurNext accepts it in writing (including email or an executed order form). Changes to scope, surfaces, nodes, or markets may adjust fees and timelines.

Fees and taxes

Fees, currency, invoicing cadence, and taxes follow the accepted quote or contract. Late payment may result in suspension after notice, without limiting other remedies.

Delivery and commissioning

Hardware shipment, installation support, and cloud enablement follow the agreed statement of work. Site access, power, networking, and safety remain the customer's responsibility unless expressly included.

Hardware, firmware, and field use

CurNext field nodes, gateways, probes, and related equipment are industrial tools. Safe installation and operation on active construction sites remain critical.

  • - Install and operate equipment according to CurNext documentation and applicable site safety rules.
  • - Do not modify hardware or firmware in ways that defeat safety, signing, or security controls.
  • - Signed OTA and firmware catalogues describe update practices; customers must allow security updates within agreed windows.
  • - Title, risk of loss, warranty length, RMA, and return rights for hardware are defined in the applicable quote or hardware schedule - not solely by these website Terms.

Intellectual property and licences

CurNext and its licensors own the CurNext name, marks, software, documentation, models, designs, and website content, except customer-owned project content and third-party materials.

  • - CurNext grants a limited, revocable, non-exclusive licence to use the website and purchased Services for your internal business purposes under these Terms and any order.
  • - Official SDKs and APIs are licensed under their published licence terms and documentation; API keys remain CurNext credentials.
  • - You retain ownership of your company data and Client project content. CurNext receives the rights needed to host, process, secure, and support that content as described in privacy and DPA documents.
  • - No licence is granted to use CurNext trademarks in a way that suggests endorsement without written permission.

Feedback

If you send ideas, suggestions, or feedback about CurNext products, CurNext may use them without restriction or obligation to you, unless a separate written agreement says otherwise.

Confidentiality

Non-public commercial, technical, and security information shared in evaluations or contracts should be treated as confidential.

  • - Each party should protect the other's confidential information with reasonable care and use it only for the engagement.
  • - Exclusions include information that is public through no fault of the receiving party, independently developed, or required to be disclosed by law (with notice where legally allowed).
  • - Security vulnerability details should be reported privately to [email protected] before public disclosure.

Privacy, cookies, and personal data

Personal data is handled under CurNext's Privacy Policy, GDPR Policies, Cookie Policy, and - for Client Data processed on instructions - the Data Processing Agreement.

  • - Website cookies and similar technologies are described in the Cookie Policy and controlled through the consent widget where required.

  • - These Terms do not reduce rights you have under applicable data-protection law.

Third-party services and links

The website and product stack may link to or rely on third-party services (hosting, payments, identity, messaging, AI assistance, maps, or weather).

  • - Third-party sites and services are governed by their own terms and privacy notices.
  • - CurNext is not responsible for third-party content or outages outside CurNext's reasonable control, except as a signed contract expressly provides.
  • - Subprocessor themes for Client Data are listed in the DPA materials.

Disclaimers

CurNext provides construction intelligence tools and evidence to support professional decisions. They do not replace engineering judgment, codes, inspections, or contractual site responsibilities.

  • - Website content is provided "as is" and "as available" for informational purposes, without warranties of uninterrupted access or error-free content, to the fullest extent permitted by law.
  • - Readiness predictions, alerts, and dashboards are decision-support tools. Customers remain responsible for go / no-go decisions, safety, and compliance on site.
  • - CurNext does not claim ISO 27001 or SOC 2 certification for itself on public marketing materials unless and until such certification is publicly stated as achieved.
  • - Nothing in these Terms excludes liability that cannot be limited under applicable mandatory law.

Limitation of liability

To the fullest extent permitted by applicable law, and unless a signed contract sets different caps:

  • - CurNext is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for loss of data, goodwill, or business opportunity, arising from website use or pre-contract engagement.
  • - For paid Services, CurNext's aggregate liability under these website Terms is limited to the fees paid to CurNext for the Services giving rise to the claim during the twelve (12) months before the event, except where mandatory law requires otherwise.
  • - Signed enterprise agreements may define different liability allocations; those agreements control when executed.

Indemnity

You agree to defend and indemnify CurNext against third-party claims arising from your unlawful use of the Services, your content, or your breach of these Terms, except to the extent caused by CurNext's wilful misconduct or gross negligence.

Suspension and termination

CurNext may suspend or terminate access to website features or product credentials when reasonably necessary to protect the platform, customers, or legal compliance.

  • - Examples include security incidents, unpaid invoices after notice, unacceptable use, or legal requirement.
  • - You may stop using the website at any time. Account closure for paid Services follows the applicable order or support process.
  • - Provisions that by nature should survive (IP, confidentiality, disclaimers, liability, indemnity, governing law) survive termination.

Governing law and disputes

These Terms are governed by the laws of Finland, without regard to conflict-of-law rules that would point elsewhere, except where mandatory consumer or local law applies to a party that cannot waive it.

  • - Courts of Finland have exclusive jurisdiction for disputes arising from these website Terms, unless a signed contract names another forum.
  • - Before filing, parties should attempt good-faith resolution via [email protected].
  • - Customers in Canada, Cameroon, and other markets may have additional mandatory local rights; those rights are not waived where waiver is prohibited.

Changes to these Terms

CurNext may update these Terms by posting a revised version on this page with a new "Last updated" date. Material changes affecting paid customers under a signed contract will follow the change process in that contract when one exists. Continued website use after posting constitutes acceptance of website-term updates for website use.
